Employee

Any person employed in a factory or establishment in connection with the business of the factory or establishment and is not an exempted one as employed in the first point is an employee under the ESI Act. ie. He need not be a person working inside the factory of establishment to be an employee, but is is enough that he is employed in connection with the business of the employer.  He may be employed outside the factory or establishment for purchase or any other filed work.  But if his work has any connection with the business of the factory or the establishment, irrespective of the place of such work, he come under the definition of the term, employee.  Second condition is that his monthly salary excluding the over time wage should not be more than Rs.15000/- per month
