Any person employed in a factory or establishment in connection with the business of the factory or establishment and is not an exempted one is an employee under the ESI Act. i.e., He need not be a person working inside the factory or establishment to be an employee, but it is enough that he is employed in connection with the business of the employer. He may be employed out side the factory or establishment for purchase of any other field wofk. But if his work has any connection with the business of the factory or the establishment, irrespective of the place of such work, he comes under the definition of the term, employee. Second condition is that his monthly salary excluding the over time wages should not be more than Rs.15000 per month.
