Dependent Benefit

Dependants' Benefit is a monthly pension payable to the eligible dependents of an insured person who dies as a result of an employment injury or occupational disease. It is payable normally from the date of death, but if the salary is paid by the employer for the day of death, the dependent benefit will be paid from the day following the date of death.

The procedures to be followed to get the dependent benefit are

1.  Once the accident resulting into the death of Insured Person happens, the accident report has to be submitted to the ESI Branch Office and the Official who is the competent authority to investigate the case will conduct a detailed investigation and the report is forwarded to the ESI Regional Office for decision.  The Regional Officer after examining the case takes a decision on whether it is an Employment Injury or not.  If the case is accepted as an Employment Injury, the said decision will be communicated to the concerned Branch Manager of ESI Corporation and the dependents have to submit the dath certificate issued by a competent authority including the claims for the dependent benefit.  In addition to the above, on the date of first payment from the Branch Office, the dependents have to submit a life certificate, which states that they are alive on that particular date.  The widow and the daughter have to submit an additional declartion tot the effect that atre not remarried or not married as the case may be.  the oife certificate and the non marriage/non remarriage as explained above have to be submitted in each January month of every year to continue the benefit for that entire year.

The dependent benefit is available in the form of monthly pension and its rate is 90% of the average adily wae as same as in the case of Temporary Disablement Benefit.  Furhter the amount which is the 90% of the average daily wage is distributed among the dependents in certain proportion fixed by the ESI Corporation.  The share of each dependent has been fixed in the fractional form and the amount of benefit available for that entire year.
